A disagreement within the Federal Court has started between two top online dating sites.
Anastasia International accused EM Online Ltd. also known as Elena’s Models with brand violations, fake promotions, tortious interference and illegal competition, in the Manhattan Federal Court. Anastasia owns the famous websites Anastasiadate and Anastasiadate.com. EM Online is a dating company located in Australia.
“The organization leading this particular court case, Anastasia, provide a service through which adult males from the U .S. are matched up with females from The Russian Federation or Ukraine. NYC has the largest market for Anastasia”, the plaintiff suggests. “EM Online directly impedes upon Anastasia’s market. We have the specified data to believe that EM Online either is in control, or is supporting, websites labeled: ‘anastasiadatefraud.com’ and ‘ruadventures.com’. These two websites disguise the identity of their owners by using a proxy service. Despite this, they “coincidentally” redirect viewers to elenasmodels.com. These websites accuse Anastasiadate of methodically perpetuating scams and bogus deceptions upon its clients, and then advise that the customers use Elena’s Models, which allegedly doesn’t follow these practices. “The anastasiadatefraud.com website purports to show extracts from e-mails authored by women with profiles on Anastasiadate.com. The e-mails are repeated, and report that ladies shown on Anastasiadate.com aren’t really women looking for love, according to anastasiadatefraud.com they’re just ladies who are paid out to talk with men The emails look to be quite fake, and so anastasiadatefraud.com could be charged with false advertisement. Anastasiadate goes to great length to ensure that the men.”
The complaint says that EM Online are voluntarily false advertising, given that they know that what they are saying is bogus, and that the email messages were composed with the only intent of wrongly ceasing Anastasiadate’s business. Quite unjustly, Elena’s Models is using ruadventures.com to fend off any competition so that it can prosper at their expense. “The ruadventures.com website, while acting to be an independently produced forum for the exchange of info about international dating services, in reality is just choosing and submitting negative details about Elena’s Models’ competitors (including Anastasia) and positive reviews about Elena’s Models service. Absolutely nothing about Anastasiadate is valid on this site, since it is quite obvious that the details have been meddled with to shed a poor light on Anastasiadate,” the complaint states.
According to Anastasia, ruadventures.com has also made illegitimate use of the copyrighted logo to appeal to clients. “Using metatags utilizing the Anastasiadate graphics, defend[ant] has positioned the two internet websites so they really appear at or on top of any web search for Anastasiadate,” according to the complaint. On the anastasiadatefraud.com site, also checked Thursday, an anonymous writer claims to inform readers “only the truth” about Anastasia date. Anastasiadate pays women to log in and pose as single women looking for love, and are paid to do this by the same company, according to him. He knows this just because a Ukrainian female that had been communicating with him actually revealed these secrets. Women are guaranteed a lot of money and decent work hours, just by chatting and emailing American men, by a third party company attached to Anastasiadate. The only listed qualifications are to be 18 or older, to understand English, and to know how to work with a computer, according to the website.
According to the same writer, the girl recommended Elena’s Models since, according to her, was a much more serious site.
